To enter, you must (a) be 18 years of age or older, (b) be a legal resident of the contiguous United States or a resident of the District of Columbia, and (c) not be a person or entity involved in the development, production, administration, or fulfillment of the Sponsors #ComeTogetherAndGrill Bundle Giveaway (the “Sweepstakes”), or an immediate family member of any such person.

By participating, you agree to be fully unconditionally bound by these Rules, and you represent and warrant that you meet the eligibility requirements set forth herein. In addition, you agree to accept the decisions of Swift (JBS) and Nexgrill (“Sponsors”), as final and binding as it relates to the content. All entries must be received by 11:59 p.m. Central Time on the last day of the Promotion Period you wish to enter. Winner selection dates are outlined in Section 7. Each person is limited to three unique entries per day per person. To constitute a Valid Entry, you must meet the eligibility requirements in Section 1 above, you must comply with the applicable entry requirements in section 3 and section 4, and your entry must be timely received by Sponsors. All late, lost, damaged, misdirected, incomplete, illegible, undelivered, or destroyed entries are invalid entries, regardless of the person responsible or cause, including, but not limited to, any problem or technical malfunction of any computer online system or server or technical problem or traffic congestion on the Internet, any social media platforms, or at our websites. Sponsors reserve the right to, in their sole discretion, cancel, suspend and/or modify this Contest or these Official Rules or disqualify any individual or entry for any reason, including but not limited to protecting the integrity of this Contest or addressing changes in business operations or other circumstances, to the extent allowed under applicable law. By participating in this Contest, each entrant agrees to be bound by these Official Rules and the decisions of the Sponsors.

A “Qualifying Post” means an original photo or video that does not contain (a) any promotional content of any other brand or trademark other than Sponsors; (b) any material that you do not have the right to use, (c) any material that is inappropriate, indecent, pornographic, obscene, hateful, defamatory, slanderous, or libelous; (d) any material that promotes bigotry, racism, hatred, or harm against any group or individual or promotes discrimination based on any impermissible category; (e) unlawful content (including any content that violates or infringes another’s rights, including but not limited to any privacy, publicity, or intellectual property rights); (f) any mention of any social media handles or websites besides those of Sponsors; and (g) any other material that Sponsors object to in their sole discretion. By submitting any content, you represent and warrant that you have obtained permission from each person whose name, image, likeness, or voice (“Likeness”) is included in the submission, and that such person(s) have granted you all necessary rights to use the person’s Likeness as described in these rules, and that you can make written copies of such permissions available to Sponsors upon request. If the Likeness of a minor (under 18 years old as of May 2, 2022) is included, you represent and warrant that the minor’s parent or legal guardian has authorized the use of the minor’s Likeness on behalf of the minor.

Winners will receive one (1) Nexgrill/Swift Prize Bundle, which includes one (1) #910-05002 Nexgrill Oakford 790 Pellet Grill ($549) and one (1) Swift Branded Box with Quality Beef and Pork Cuts ($300) at a total approximate retail value of $849. Actual/appraised value may differ at time of prize award. The specifics of the prize shall be solely determined by the Sponsors. No cash or other prize substitution permitted except at Sponsor’s discretion. The prize is non-transferable. Any and all prize-related expenses, including without limitation any and all federal, state, and/or local taxes, shall be the sole responsibility of the winner. No substitution of prize or transfer/assignment of prize to others or request for the cash equivalent by winners is permitted. Acceptance of prize constitutes permission for Sponsors to use winner’s name, Likeness, and entry for purposes of advertising and trade without further compensation, unless prohibited by law.

The odds that a valid entry will be selected during the Promotion Period are one out of the total number of valid entries received on a nationwide basis from all methods of entry for the Promotion Period. The maximum number of entries and the exact odds cannot be determined.

Certain influencers and/or celebrities will be selected by Sponsors and will serve as judges (collectively, “Judges”) of the Sweepstakes. The Judges will review and judge the Valid Entries based on uniqueness, authenticity, and alignment with Sweepstake’s direction and guidelines. The entrant tentatively selected as the winner will be notified on or about May 18, 2022, for the Memorial Day prize, June 7, 2022, for the Father’s Day prize, and June 23, 2022, for the Fourth of July prize via direct message on the platform the Valid Entry originated from. As a condition to final selection as the winner, the entrant must timely comply with the prize acceptance requirements below. If the selected winner cannot be contacted, is ineligible, fails to claim the prize within 48 hours from the time award notification was sent, or fails to timely return a completed and executed declaration and releases as required, prize may be forfeited, and an alternate winner selected.

The receipt by winner of the prize offered in this Sweepstakes is conditioned upon compliance with any and all federal and state laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY ANY WINNER (AT SPONSORS’ SOLE DISCRETION) WILL RESULT IN SUCH WINNER’S DISQUALIFICATION AS WINNER OF THE SWEEPSTAKES AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.

By participating in this Sweepstakes, each entrant (a) grants to Sponsors an irrevocable, perpetual, unrestricted and worldwide right to publish, reproduce, distribute, display, perform, create derivative works, transmit or disseminate the Qualifying Post and entrant’s name and Likeness in all media or platforms, whether now known or hereafter invented, including as part of its advertising and promotional materials, regardless of the type of media, the content of the advertisement or promotion, or the manner of publication, broadcast or distribution (including, without limitation, internet) and (b) agrees (i) to be bound by these Official Rules and the decisions of Sponsors; (ii) to release and hold harmless Sponsors and each of their employees, officers, or directors and any of their or Sponsors’ affiliates, advertising and promotional agencies, or other person or entity involved in the development, production, administration or fulfillment of this Sweepstakes from any and all losses, damages, claims and actions of any kind arising from this Sweepstakes or from the acceptance, possession or use of any awarded prize, including, without limitation, claims based on publicity rights, defamation or invasion of privacy; (iii) to release and hold harmless any social media platform through which they enter or interact with the Sweepstakes (including but not limited to Twitter, Facebook, Instagram, and/or TikTok); (iv) that Sponsors may send to such entrant marketing, advertising and promotional materials to any address or point of contact (e.g., mail, email, or social media handle) provided in the Qualified Post; (v) that any action at law or in equity arising out of or relating to this Sweepstakes or the prizes shall be governed by the law specified in 10 below and shall be filed only in the state or federal courts located in Greeley, Colorado, and entrant hereby consents to the personal jurisdiction of such courts for purposes of any such action; and (vi) that Sponsors are not responsible for and cannot be held liable for unauthorized human intervention, technical errors, printing errors, mail delays, or any other errors in the administration of this Sweepstakes.

Sponsors reserve the right, in their sole discretion, to cancel, terminate, modify, or suspend the Sweepstakes in the event of a virus, bugs, non-authorized human intervention, fraud or other causes beyond its control that corrupt or affect the administration, security, fairness or proper conduct of the Sweepstakes. In such case, Sponsors may select the recipients from all eligible entries received prior to and/or after (if appropriate) the action taken by Sponsors, in their sole discretion. Sponsors reserve the right at their sole discretion to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Sweepstakes or the website or violates these Official Rules.

By entering, each entrant agrees to release and hold harmless Sponsors and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers and directors from any liability, illness, injury, death, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) such entrant’s participation in the Sweepstakes and/or their acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware, or software; (iii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Promotion; and (v) electronic or human error which may occur in the administration of the Promotion or the processing of entries. Sponsors shall have the right and sole discretion to (i) edit, (ii) refuse to air or transmit, or (iii) cease to air or transmit any content, including any Qualifying Post, which it finds to be in violation of these Official Rules, or which it finds in its sole discretion to be otherwise objectionable for any reason, including with respect to Sponsors’ standards and practices and other policies. Sponsors also reserve the right to replace the winner’s Qualifying Post with the Qualifying Post of an alternate eligible entrant in accordance with these Official Rules if such Qualifying Post and/or entrant is withdrawn from or removed from the Sweepstakes for any reason, including without limitation, entrant’s failure to have Sponsors’ documents executed by third parties. All statements and opinions made by entrants are those of such entrants only, and Sponsors neither endorse nor shall be held responsible for the reliability or accuracy of same. Sponsors are not responsible for the content or practices of Twitter, Facebook, Instagram, or any other third-party websites that may be linked to the Sweepstakes.

THIS SWEEPSTAKES IS GOVERNED BY THE LAWS OF the State of Colorado, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Sweepstakes, entrant agrees that any and all disputes which cannot be resolved between the parties and causes of action arising out of or connected with this Sweepstakes, shall be resolved individually, without resort to any form of class action exclusively before a court located in Colorado having jurisdiction. Further, by entering this Contest, Participant expressly waives any and all rights to claim or recover punitive, incidental, and consequential damages, damages for personal or bodily injuries, attorneys’ fees (prevailing party or otherwise), and specifically agrees that participant’s damages will be limited to participant’s reasonable and actual out-of-pocket expenses associated with entering this Sweepstakes. Participant further waives any and all rights to have damages multiplied or increased and waives any and all statutory penalties.

This Sweepstakes is in no way sponsored by Meta (Facebook or Instagram) or any other party that Sponsors may work with in relation to this Sweepstakes.
